Court Rules Against Texas Injunction Regarding WomenÂ’s Health reports Women Health Center

(EMAILWIRE.COM, December 27, 2012 ) San Francisco, CA -- The federal court in Waco Texas denied the state an injunction that would have allowed it to receive Medicaid dollars in order to fund the healthcare providers it believes should be part of Women's Health Program, denying funds from Planned Parenthood if it chooses.

"Once and for all, we implore Texas to put politics aside and put womenÂ’s health first," Planned Parenthood of Greater Texas CEO Ken Lambrecht said in a statement after the court ruling. "The WomenÂ’s Health Program and Planned Parenthood have worked together to provide women with essential health services, including cancer screenings, birth control, and well-woman exams, for the past five years," and could continue to do so, he said.

The state had previously filed the injunction in federal court earlier in the year. It had sought to have Medicaid funded despite the provisions of federal law that disallow the state from discriminating among Medicaid-qualified providers. A similar suit was denied by Texas' 7th Circuit Court of Appeals earlier in the fall.

The major issue was the state's decision to simply defund Planned Parenthood from the Women's Health Program, based upon its own beliefs. Medicaid dollars had been supporting the program almost exclusively for the previous half-decade. The federal government had been pitching in a 9-to-1 ratio compared to the state in that time-frame.

It as decided by the state that this year the program would be reworked in order to ban the Planned Parenthood program. The organization is the largest provider of WHP services, and serves an estimated 50,000 women who are enrolled in the program.

The state's plan was to leave tens of thousands of individuals without access to their chosen provider. That move was at odds with the federal stance, and so the state chose to go at it alone. Today, the federal court of Waco denied the injunction and will now allow the prohibition of federal money from withholding from the WHP when it comes to Medicaid dollars.
