(EMAILWIRE.COM, July 30, 2013 ) San Francisco, CA -- The indictment was filed last week in the US District Court in Minneapolis, Minnesota and alleges that several owners of Mall of America kiosks knowingly recruited foreign citizens on visas to work at kiosks. All four men are legal permanent residents of the United States, but were originally in the US on tourist/visitor visas.
At least seven people employed at one of the four kiosks were ineligible to work in the US and worked between June 2009 and June 2013 at Ya & Ya USA, a natural beauty and hair company. The criminal complaint filed last month describes how the men recruited employees as far away as California or Israel, and one of the workers even said under oath that one of the owners knew of the employeesÂ’ work status.
The Minnesota Department of Employment and Economic Development also reports that the owners didnÂ’t release some wages to the government, as there are no records of anyone working for the company in the previous three years. Ya & Ya also didnÂ’t provide I-9s for employees during a Homeland Security audit the company underwent in August of 2012.
Meanwhile, the kiosks at the Mall of America remain open. Attorneys for the defense, the owners, said the majority of the companyÂ’s employees are US citizens and the company is legally allowed to resume work with those eligible employees.
